A substitute teacher who was fired for giving a bible to a student is appealing the feds' dismissal of a religious discrimination claim.

PHILLIPSBURG, N.J. -

A substitute teacher who was fired for giving a bible to a student is appealing the feds' dismissal of a religious discrimination claim.

The Liberty Institute wants the Equal Employment Opportunity Commission to reconsider its dismissal of Walter Tutka's claim against the Phillipsburg School District.

The Texas-based institute says the EEOC dismissed it for insufficient information after asking for additional information.

The district removed Tutka from the substitute teacher list after the Bible incident.

The Liberty Institute says Tutka was fired because he's a member of Gideons International which distributes bibles.
