Tenant suing landlord, trash hauler over injuries suffered while he was disposing of garbage

A tenant is suing his landlord and a trash hauling company in connection with an accident that badly injured him as he crossed the street to dispose of his garbage.

Jeffrey Heilman, of Easton, filed a civil suit last week in Northampton County Court against Gary Ziegler, Christopher Wilhelms and West River Corp., 43 North Delaware Drive, and Herman, Michael and Evangeline Swint and Swint Hauling & Disposal Service, 602 Folk St., all of Easton.

Heilman says in the suit that on July 19, 2010, he was struck by a vehicle while crossing North Delaware Drive to dispose of his trash in a garbage bin located in a parking lot across the street from his apartment.


Heilman, who lived at the apartment since April 15, 2006, suffered back, head and neck injuries and tore up his left knee, according to the suit.

Heilman says in his suit that Ziegler, Wilhelms and West River Corp.
were careless and negligent for not providing a way for him to dispose of his trash without having to cross a road as "busy" and "dangerous"
as North Delaware Drive.

The suit says the Swints and Swint Hauling & Disposal were responsible for placing the garbage bin in the parking lot; should have known that crossing North Delaware Drive was dangerous, and should have provided a safer means of trash disposal.

Heilman is asking for more than $50,000 in damages, according to the suit. reached out to Atty. Fred Miller of Norristown, Montgomery Co., who is listed in the suit as representing West River Corp. and Swint Hauling & Disposal Service, but our call was not returned.
