Amended lawsuit filed against bars in deadly DUI crash

EASTON, Pa. -

The families of two motorcyclists who died in a head-on crash with a pickup truck in Northampton County last year, and five other bikers who survived, are continuing a civil lawsuit against three bars and the man accused of causing the fatal accident.

Keith Michaelson, of West Milford, N.J., and Michael Zadoyko, of Pompton Lakes, N.J., were killed July 1, 2011, when their motorcycles were hit by a truck driven by John Heaney III on Route 512 in Bangor, police said.

Heaney, a former cop from Lopatcong Township, N.J., is also facing a trial on homicide by vehicle charges.

Michaelson and Zadoyko's estates and the other bikers filed an amended civil lawsuit in Northampton County Court late last week. They said two bars in Stroudsburg, Monroe Co. -- The Sarah Street Grill and KC's Pub -- and another in Bangor -- the Bangor Jacksonian Club -- served alcohol to Heaney while he was intoxicated on the afternoon of the crash.

They are seeking an unspecified amount in damages for the bars' alleged negligence and recklessness for selling alcohol to Heaney and then failing to
prevent him driving, according to court documents.

Attorneys for The Sarah Street Grill and the Bangor Jacksonian Club asked the court last month to dismiss the case.
