Retrial resumes for man convicted of killing Phillipsburg woman in 2006

After a brief recess to interview jurors, a Warren County judge allowed testimony to resume Friday morning in the retrial of a man convicted of killing an elderly woman six years ago.
Judge Ann R. Bartlett delayed the trial briefly because a local newspaper in view of the jurors had the word 'retrial' in a headline.
Officials said jurors were not supposed to know this is Frey's second trial.
After the judge talked to each juror, the trial resumed.
Thor Frey is being tried again for the murder of 75-year-old Mary Bostian in 2006 in her Phillipsburg home.
He was convicted in the first trial in 2009 but granted a new trial, which started this week.
In Friday's testimony, two witnesses placed Frey and Donald O'Grady at the Snack Bar, a tavern on Fillmore Street in Phillipsburg, on Aug. 17, 2006, the night before Mary Bostian was murdered, and another testified that Frey was a guest at a hotel in Wind Gap, Northampton Co., Pa., for several days when he was arrested.
Bartender Tara Dreitline of Alpha, N.J., testified O'Grady and Frey came into The Snack Bar on Aug. 17, 2006, and were drinking into the early morning hours of Aug. 18.
She said neither man appeared intoxicated, and that they both left the bar when she did, at closing time, at 2 a.m.
Eric Abel of Phillipsburg, a Jersey Central Power & Light Co. employee, corroborated Dreitline's testimony, saying he did not think O'Grady and Frey were drunk when they left the bar behind him and Dreitline, whom he was walking home.
Rujjal Modi, manager of the Travel Inn Hotel in Wind Gap, testified that Frey registered under his original name, Theodore LaCour, at his hotel on Aug. 19, 2006, and was arrested in Room 136 after he provided Frey's registration card to police on Aug. 24.
At prosecutor Kelly Shelton's request, Modi left the witness box and stood before an easel to draw a picture of the hotel's layout.
