Defendants respond to lawsuit over mandatory retirement age for judges

State officials are responding to a lawsuit filed by two local judges over a law that requires them to retire at the age of 70.

The suit was filed by judges Leonard Zito of Northampton County and Alan Rubenstein of Bucks County.

They say the age requirement is discrimination.. so they're suing Governor Corbett, State Treasurer Rob McCord and several other state officials.

Now Treasurer McCord has responded to the lawsuit saying he's not the proper authority to defend the constitutionality of the mandatory retirement age.

Governor Corbett and State Secretary Carol Aichele have also filed paperwork objecting to the lawsuit.

All three parties are asking to be dismissed from the case.
